Data protection notice

The processing of personal data is subject to the EU General Data Protection Regulation (GDPR). This data protection notice informs you how Fresenius SE & Co. KGaA and its affiliated companies ("we" or "Fresenius") process personal data of you as a user of stayFresenius ("stayFresenius" or "website") and what kind of data is involved.

"Personal Data" means any information about you as a user.

"Processing" means any operation performed upon personal data, such as collection, storage, organisation, structuring, adaptation or alteration, retrieval, consultation, use, disclosure, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

With this data protection notice, we explain to you in detail, in particular:

  • who is responsible for processing your personal data and whom you can contact if you have any questions or wish to make a complaint (section 1);
  • what personal data we collect and how we do it (section 2)
  • for what purposes we process your personal data and what legal basis we rely on in this regard (section 3)
  • to whom we may transfer your personal data (sections 4 and 5);
  • how long we store your personal data (section 6);
  • whether you have to provide your personal data (section 7);
  • how you can update, correct or delete your personal data and exercise other rights in relation to your personal data (section 8); and
  • in what other situations your data may be processed and how to contact us (section 9).

1. Controller and contact details

The controller responsible for the processing of your personal data is Fresenius SE & Co. KGaA, Else-Kröner-Straße 1, 61352 Bad Homburg vor der Höhe, email: stay@fresenius.com.

According to the GDPR, we are obliged to provide you with the contact details of the data protection officer. You can contact the data protection officer by sending a letter to the postal address of the controller for the attention of the Data Protection Department or by email via dataprotection@fresenius.com.

2. Processing of your personal data

2.1. Recording of technical characteristics when visiting the platform

When you visit our platform, the web server temporarily records the following categories of data:

  • the domain name or IP address of your computer,
  • the file request of the client (file name and URL),
  • the http response code,
  • the website from which you are visiting us,
  • which internet browser and operating system you are using,
  • the type of your device,
  • the date of your visit,
  • as well as how long you have stayed here.

Your IP address is only recorded anonymously, with the last block of numbers (octet) shortened. 

2.2. Registration

To access stayFresenius, you need a user name and a password. These data, which are identical for all users, can be found on the Fresenius intranet.

If you have a Windows account at Fresenius, you can use the Single Sign-On (SSO) procedure to log in. You can log in with your user name and your Windows password.

If you want to publish job advertisements on stayFresenius as a recruiter, you need an individual user name and password. You can contact the stayFresenius team to get your access data.

2.3. Bookmarking of job advertisements

If you bookmark certain job advertisements, we store this information in the so-called local storage (also called local memory) on your terminal device.

When using the so-called local storage, the data are stored locally in the cache of your computer. These data also remain stored after you close the browser window or the programme and can therefore be retrieved.

These data are not shared with third parties. In contrast to cookies which are partially deleted after the end of the session or after a specified lifetime of a cookie, the data in the local storage are only deleted when you delete the cache.

2.4. Job Alert

You can register for corresponding job alerts for your search criteria by entering your email address. We verify your registration by using the so-called double opt-in procedure. This means that we first request active confirmation of your registration by email to the email address you provided in the course of registration before we start sending job alerts corresponding to your search criteria. We use the information about the confirmation to document and, if necessary, prove your registration.

You can unsubscribe from receiving the job alert at any time by clicking on the unsubscribe link in the job alert you receive. We will then no longer use your email address to send you the job alert.

2.5. Use of cookies

To provide you with the best user experience, we use cookies and similar technologies. Cookies are small text files that are stored locally on your terminal equipment by your web browser. These include cookies for the operation and optimisation of the site as well as for individualised functions and for advertising based on your online usage behaviour. We would like to give you the choice of which cookies you allow via the cookie settings. You can access these settings again at any time via the footer of the website to manage your preferences.

You can delete cookies at any time, even if they have already been used. You have the option of fully accepting or rejecting cookies and setting specific preferences via the query that appears when you visit our website and the cookie settings that can be accessed via the footer of the website. Cookies that are necessary for the provision of the web service cannot be rejected.

Please note that your cookie settings always refer to the internet browser you are using. If you call up the site using a different internet browser, you will have to make this setting again. 2.5.1. Required cookies

These cookies are necessary for you to navigate the website and use essential functions. They enable basic functions such as accessing secure areas or setting your privacy preferences. If you block these cookies via your browser settings, some or all of these functions may not work properly.

2.5.2. Analytical cookies

This website uses Google Analytics, a web analytics service provided by Google LLC ("Google"). Google Analytics uses cookies, which are text files placed on your computer, to help the website analyse how users use the site. The information generated by the cookie about your use of the website (including your shortened IP address) will be transmitted to and stored by Google on servers in the United States.

Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf.

2.5.3. Services from other companies (autonomous service providers)

Third-party services are integrated on our pages, which provide their services on their own responsibility. When visiting our pages, data is collected by means of cookies or similar technologies and transmitted to third parties, partly for Fresenius' own purposes. To what extent, for what purposes and on what legal basis further processing for the third-party provider's own purposes takes place, please refer to the third-party provider's privacy policy.

3. Purposes pursued and legal bases for processing.

We process the technical characteristics when visiting stayFresenius (see section 2.1) to ensure the security and functionality of stayFresenius. The legal basis is section 25 (2) (2) German Telecommunications Telemedia Data Protection Act (TTDSG) and Article 6 (1) (1) (f) GDPR.

In order to carry out your registration (see section 2.2) and to save the job advertisements that have been bookmarked (see section 2.3), we process your personal data. The legal basis is section 25 (2) (2) TTDSG and Article 6 (1) (1) (f) GDPR.

We process your email address and your stored search criteria to send you job alerts (see section 2.4). The legal basis is Article 6 (1) (1) (a) GDPR.

We use the required cookies (see section 2.5.1) to ensure the essential functions of stay.Fresenius. The legal basis is section 25 (2) (2) TTDSG and Article 6 (1) (1) (f) GDPR.

We obtain your consent for the use of cookies that are not mandatory (see sections 2.5.2 and 2.5.3). The legal basis is section 25 (1) (1) TTDSG and Article 6 (1) (1) (a) GDPR.

4. Possible recipients of your personal data

In order to fulfill the aforementioned purposes, we may share your personal data in whole or in part with other group companies and/or service providers. In addition, the following categories of recipients may receive your personal data:

  • Authorities, courts, parties to a legal dispute or their designees to whom we are required to provide your personal data by applicable law, regulation, legal process or enforceable governmental order, e.g., tax and customs authorities, regulatory authorities and their designees, financial market regulators, public registries;
  • auditors or external consultants such as lawyers, tax advisors, insurers or banks, and
  • another company in the event of a change of ownership, merger, acquisition or disposal of assets.

5. International data transfers

In order to fulfill the aforementioned purpose, we may transfer your personal data to recipients outside Germany. Transfers within the European Economic Area (EEA) always take place in accordance with the uniform EU data protection level.

Transfers to third countries are always carried out in compliance with the supplementary requirements of Article 44 et seq. GDPR.

Your personal data may be transferred to certain third countries for which an adequacy decision of the EU Commission determines that an adequate level of protection exists in accordance with the uniform EU level of data protection. As a rule, EU standard contractual clauses (“SCC”) are concluded with the recipient for transfers to other third countries. These have been issued by the EU Commission to safeguard such international data transfers.

To transfer personal data outside the EEA among group companies of the business segments Fresenius Kabi (Fresenius Kabi AG and its affiliated companies) and Fresenius Corporate, we implemented binding corporate rules (“BCR”) approved by the data protection authorities in accordance with Article 47 GDPR. A copy of the SCC and the BCR can be requested via dataprotection@fresenius.com.

Ultimately, personal data may be transferred on the basis of an exceptional circumstance under Article 49 GDPR.

6. How long we store your personal data

If you do not click on the confirmation link we send to your email address after creating a job alert within 7 days, your job alert will be automatically deleted with all data. The job alert data will be deleted when you click the unsubscribe link in the job alert.

The user accounts of recruiters are deleted as soon as the user no longer requires access due to a change in the area of responsibility or departure from the company.

The information on the storage period of the cookies can be found in section 2.5.

7. Provision of your personal data

You are not obliged to provide your personal data. If you do not provide your personal data, you will not be able to use certain functions of stayFresenius (e.g., job alert or services of external service providers).

8. Your rights

According to the GDPR, you are entitled to various rights. You have the right to access your personal data (Article 15 GDPR, section 34 et seq. BDSG), to correct incorrect personal data (Article 16 GDPR), to delete your personal data under certain circumstances (Article 17 GDPR, section 34 et seq. BDSG) and to restrict the processing of data under certain circumstances (Article 18 GDPR).

In the case of processing based on consent, you have the right to withdraw your consent (Article 7 (3) GDPR). The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

If the processing is based on consent and carried out by automated means, you have the right to receive personal data you provided to us in a structured, commonly used, machine-readable format and to transmit your personal data to another controller (Article 20 GDPR)

Right to object on a case-by-case basis

In case the processing is based on Article 6 (1) (1) (f) GDPR, you have the right to object to the processing of your personal data on grounds relating to your particular situation (Article 21 (1) GDPR).

You also have the right to lodge a complaint with a supervisory authority, in particular, in the Member State of your habitual residence, place of work or of an alleged infringement of the GDPR (Article 77 GDPR in conjunction with section 19 BDSG). The responsible data protection authority for Fresenius is "Der Hessische Beauftragte für Datenschutz und Informationsfreiheit", Postfach 3163, 65021 Wiesbaden. The right of appeal is without prejudice to any other administrative or judicial remedy.
